1. Order Submission & Review Process: Orders will not be processed or finalized until payment is received in full. We reserve the right to refuse or cancel any order for any reason before finalizing.
2. Address Accuracy & Recipient Information: Customers are responsible for reviewing and verifying all recipient names, addresses, and delivery details prior to checkout. The Sweet Tooth is not responsible for incorrect, incomplete, or undeliverable addresses provided by the customer. Failed deliveries due to incorrect information may result in additional fees for redelivery.
3. Payment Terms: Payment is due when you place your order. Check, ACH bank transfer, or Zelle. No additional fee applies to these payment methods. Credit card payments include a 3% processing fee.
4. Delivery Dates & Timing: Delivery dates are estimates only and not guaranteed. We will make every reasonable effort to deliver on or near the requested date, but deliveries may occur 1-3 business days before or after the specified date due to logistics, weather, or other factors beyond our control.
5. Local Delivery: Local delivery is available in Miami-Dade and Broward counties. Delivery fees are based on zip code and calculated at checkout. Recipient must be available to receive delivery or provide delivery instructions. We are not responsible for items left unattended per delivery instructions.
6. Shipping Orders: Shipping orders are processed through our fulfillment partners. We are not responsible for delays caused by shipping carriers.
7. Undeliverable Orders, Returns & Pickup: If a delivery is returned, refused, or undeliverable, the order will be held for 7 days at The Sweet Tooth facility in North Miami Beach for pickup. No appointment required. If redelivery is requested, additional delivery fees will apply and are paid directly to the delivery company.
8. Product Quality & Freshness: All products are made fresh to order using premium ingredients. We maintain strict quality standards to ensure your gifts arrive beautifully.
9. Allergen & Gluten Disclaimer: All products are made in a facility that processes peanuts, tree nuts, wheat, gluten, milk, soy, and eggs. While we take great care to avoid cross-contact, all items may contain trace amounts of these allergens. We are not certified gluten-free or nut-free. Customers with severe food allergies or sensitivities should use their discretion when consuming our products.
10. Kosher Certification: All products are certified kosher by Kosher Miami. Holiday baskets contain dairy unless otherwise specified.
11. Gift Messages: Gift messages are printed on cards and included with each order. Please ensure messages are appropriate and do not contain offensive content. The Sweet Tooth reserves the right to refuse printing any message deemed inappropriate.
12. Cancellations & Changes: Draft orders may be cancelled or modified at any time before payment. Once payment is received and orders are finalized, cancellations or modifications up to 48 hours before the scheduled delivery/ship date: no charge. Cancellations made 24-48 hours before delivery: 50% cancellation fee. Cancellations made less than 24 hours before delivery: No refund.
13. Returns & Refunds: Due to the perishable nature of our products, we do not accept returns. If you receive a damaged or defective product, please contact us within 24 hours of delivery with photos for a replacement or refund.
14. Gratuity (Optional): It's completely up to you. 100% of your gratuity goes to our team as a holiday bonus.
15. Liability Limitations: The Sweet Tooth's liability is limited to the purchase price of the products. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products or services.
16. Privacy & Data Protection: We respect your privacy and will not share your information with third parties except as necessary to fulfill your order (e.g., delivery partners, payment processors).
17. Disputes & Governing Law: Any disputes arising from these terms shall be governed by the laws of the State of Florida and resolved in Miami-Dade County courts.
18. Updates to Terms: By completing a purchase, you acknowledge that you have read and agree to these terms and that The Sweet Tooth may update these terms at any time without prior notice. The most current version will always be available on this page.
